Real Estate Licensing in New Brunswick

In New Brunswick, the government regulates the licensing of persons who "trade in real estate" by way of the Real Estate Agents Act which is administered by the Minister of Justice through the Department of Justice and Consumer Affairs .

The top class of real estate license is issued to an Agent:
 
"An agent's license is issued to the corporate body, partnership or individual who is legally responsible for contracts, financial accountability, advertising, sales representatives and other matters respecting the trading in real estate."

The Agent must furnish a bond and the agent is responsible for consumer's deposits held in trust. Some Agents employ salespeople and some do not.

A salesperson may only be licensed if:
 
"he files with the Minister a declaration by an agent that he is to act as a salesman employed by and representing that agent; "

So here's a tip for buyers and sellers.
When first meeting a real estate licensee, ask how they are licensed and who they represent.
